§ 1. Definitions.

  • For the purpose of this ordinance, the following terms shall have the meaning set forth below. The word "shall" is mandatory and not merely directory.

    Act is the Cable Communications Policy Act of 1984.

    Basic cable service means any service tier which includes the retransmission of local broadcast signals as defined in Section 602(2) of the Act.

    Board of supervisors or board is the Board of Supervisors of the County of Amherst, Virginia.

    Cable operator is VACAR Cablevision, Ltd. VACAR Cablevision, Ltd. is a limited partnership organized and existing under the laws of North Carolina, with its principal office and place of business located at 450 North Winstead Avenue, Rocky Mount, North Carolina.

    Cable system, hereinafter also referred to as "CATV System", means a system for the transmission of audio and/or video signals by coaxial cable or other means and such related services as the state of art permits and Grantee chooses to provide and as further defined by Section 602(6) of the Act. Such services include, but are not limited to, "Basic cable service" and "Premium service."

    County is the County of Amherst, Virginia.

    Franchise is the term applied to a nonexclusive license granted pursuant to this ordinance, and as defined by Section 602(8) of the Act, after adoption by the Board and acceptance by the Cable Operator, for the construction and operation of a cable system.

    Franchising authority is the county of Amherst, Virginia.

    Operator gross revenues shall mean those revenues derived by cable operator from the provision of basic cable service and premium service to subscribers, together with installation and service charges.

    Person is any natural person, firm, partnership, association, corporation, company, or legal entity or organization of any kind.

    Premium service means any service or services not included in "Basic service".

    Subscriber is a person who purchases service offered by the Cable Operator.
