§ 6. Construction and maintenance.

  • (a)

    All structures, lines, and equipment erected by the cable operator within the county shall be so located as to cause minimum interference with the proper use of streets, alleys, public utility easements, and other public ways and places, and to cause minimum interference with the rights or reasonable convenience of property owners, and cable operator shall comply with all proper and lawful ordinances of county now or hereinafter in force.

    (b)

    In case of any disturbance by cable operator of pavement, sidewalk, driveway, or other surface, cable operator shall, at its own cost and expense, replace and restore all paving, sidewalk, driveway, or other surface so disturbed in as good condition as before the work was commenced, except as otherwise may be agreed between landowner and cable operator.

    (c)

    In the event that any time during the period of this franchise the county lawfully elects to alter to [or] change any street, alley, public utility easement, parking lot, or other public way owned or controlled by [the] county, which requires the relocation of [the] cable operator's facilities, then, in such event, [the] cable operator, upon reasonable notice by [the] county, shall remove, alter, and relocate the same at its own expense.

    (d)

    In the event that, at any time during the period of this franchise, any person desires to move any structure and thereby the temporary or permanent alteration of [the] cable operator's CATV System, installations, lines, facilities, or equipment, [the] cable operator may require the payment by such person of the reasonable cost of such alteration in advance. Notification of any such move must be given to [the] cable operator one week in advance.

    (e)

    All poles, lines, structures, and other facilities of [the] cable operator in, on, over, and under streets, sidewalks, alleys, public utility easements, public grounds or places of [the] county shall be kept by [the] cable operator at all times in a safe and substantial condition, and in good order and repair.

    (f)

    Nothing in this section shall be construed to refer to the lawful right of [the] county to zone, plan, or subdivide land; and further nothing in this section shall be construed to refer to the county exercising its authority to require property owners to abide by the lawful ordinances of the county and of the Commonwealth of Virginia.
