§ 15. Information to be provided to board.

  • (a)

    No grant of a franchise, renewal thereof, transfer thereof, or assignment thereof shall become effective until the following information is filed with the board:

    (1)

    In the case of any individual, partnership, or unincorporated association, the names and addresses of all persons having a proprietary or equitable interest in and to the business operation or franchise of [the] cable operator. The term "equitable interest" shall include all assignments for value, as well as all contingent assignments or any right or privilege under the franchise, and shall include any benefit, payment, or emolument whatsoever resulting from the grant of the franchise under this ordinance. If the applicant is a non-public corporation, there shall be furnished the names and addresses of the officers, directors, and shareholders of the corporation, the number of shares held by each shareholder.

    (3)

    If the applicant is a publicly held corporation (i.e., more than fifty (50) shareholders), the application shall set forth the state in which the corporation was incorporated and/or qualified to do business, and the names and addresses of the officers, and directors, and the names of stockholders holding more than ten (10) percent of the shares of the corporation.

    (4)

    If another corporation owns fifty (50) percent or more of the applicant's outstanding capital stock, the same information acquired by subparagraphs 2 or 3 of this section, whichever is applicable, shall be provided for such other corporation.

    (5)

    The application shall set forth the full disclosure of the ownership of the facilities used in rendering the CATV service required under the franchise.

    (6)

    The application shall set forth the schedule of rates to be charged subscribers for the installation of equipment and regular subscriber services, the facilities to be employed, the general routes of cables used in redistributing signals, the service area or areas, the proposed commencement and completion dates of construction additions to the cable television system, and the proposed dates service will be available to the additional areas named.

    (b)

    The board may request such other reasonable information as it may deem appropriate, and such information shall be promptly provided to the board.

    (c)

    All information provided under this act shall be available for public inspection and shall be kept on file for a reasonable length of time as directed by the board.

    (d)

    All information provided under this section shall be regularly updated and kept current by the cable operator.
